Permits and code on the Space Coast

The rules below are public facts about the building departments and codes that govern home renovation in Brevard County. They describe the jurisdictions, not any one contractor, and each linked page is the authority for the claim beside it. Rules and fees change, so confirm details with the department before work starts.

Which building department handles a renovation in Brevard County?

It depends on where the address sits. Brevard County issues building permits for new construction, alterations, additions and changes to properties in unincorporated areas, and its permit FAQ explains how to confirm a property’s jurisdiction from the Taxing District shown on the property appraiser’s record (Brevard County building permits, permit FAQ). Inside city limits, the municipality runs its own department. The Town of Indian Harbour Beach has a Building Department whose Building Official issues permits, inspects work and issues certificates of occupancy (Indian Harbour Beach Building Department). The City of Melbourne’s Building Section handles permitting, plan review and inspections for building, electrical, mechanical and plumbing work (Melbourne Building Section). Satellite Beach, Palm Bay and Cocoa Beach each publish their own permit pages as well (Satellite Beach, Palm Bay, Cocoa Beach).

Does a kitchen remodel in Satellite Beach need a permit?

Most likely yes. The City of Satellite Beach states that a permit is needed for most work, including new construction, additions, interior remodels, electrical, plumbing, mechanical, roofing, fencing and accessory structures. Its page adds that only a licensed contractor registered with the state Department of Business and Professional Regulation or with Brevard County may apply for a permit (Satellite Beach permit information). The same logic applies to a bathroom or whole house renovation, because wiring, plumbing and ductwork changes are separate permitted trades.

What counts as permitted work in Melbourne?

The City of Melbourne’s building FAQ lists room additions among the projects that typically need a permit. It also names work homeowners often miss, such as re-roofing, window and door replacement, air conditioner change-outs, electrical and plumbing work, generators and fences, and it warns that work started without a permit can bring higher costs, delays or removal of the work (Melbourne building FAQ).

What does flood regulation mean for a whole house renovation near the water?

Barrier-island and riverfront towns such as Indialantic, Melbourne Beach, Satellite Beach and Indian Harbour Beach contain mapped flood zones. Brevard County’s Public Works office states that any development in the floodplain requires a building permit under Chapter 22 of the county code, publishes the current flood zone map, and supplies FEMA elevation certificates for structures in unincorporated special flood hazard areas (Brevard flood zone information). Satellite Beach adds a substantial damage threshold: when repairs or improvements reach fifty percent of a structure’s market value, excluding land, the building must meet current standards as if it were new (Satellite Beach flood insurance update). A large renovation of an older house can cross that line, so the valuation question belongs at the start of planning.

Which statewide code applies?

The Florida Building Code is adopted by the Florida Building Commission under Part IV of Chapter 553, Florida Statutes, and is enforced by state and local government agencies (Chapter 553, Florida Statutes). The edition in force on the day an application is submitted is the one that applies, and the Florida Building Code Online site hosts the current text (Florida Building Code Online). Indian Harbour Beach’s permit forms include an owner-builder disclosure, a notice of commencement and a roof affidavit, which shows the paperwork a residential job can involve.

Can a homeowner pull the permit personally?

Brevard County allows it, with conditions. Its permit page says online permitting is available only to licensed contractors, and that owners acting as their own contractor, called owner-builders, must appear in person to file a permit application (Brevard County building permits). Indian Harbour Beach publishes an owner-builder disclosure among its forms (Indian Harbour Beach Building Department). In Satellite Beach the city says only a licensed contractor registered with the state or with Brevard County may apply, so the owner-builder route is a question to put to each department before planning around it.

Who is responsible if work starts without a permit?

Cocoa Beach states that the property owner, not the contractor, is ultimately responsible for obtaining the permit, and that an owner may be cited when work begins without one. The same page lists air conditioning replacements, electrical and plumbing work, decks, docks, boat lifts, driveways and fences among the work the Building Division covers, and it invites residents to call the division to verify a contractor’s status before signing a contract (Cocoa Beach Development Services). Melbourne gives the same warning in its own words: unpermitted work can mean higher costs, delays or removal (Melbourne building FAQ).

How long does review take?

Review times are set by each city and change with volume. Satellite Beach reports that permits are typically reviewed in about three business days (Satellite Beach permit information). Melbourne reviews plans in the order they arrive, and the permit holder is responsible for scheduling each required inspection before moving to the next phase of work (Melbourne Building Section). A department’s own page is the only reliable source for the current figure.

Questions clients ask

Can we stay in the house during a renovation?

Staying in the house depends on which rooms are in scope and on whether water, power or the kitchen is out of use during the work. The estimate names the rooms in scope.

Who pulls the permits?

Brevard County's building department accepts a permit application from a licensed contractor or from an owner-builder; each city sets its own rule, and Satellite Beach accepts licensed contractors only. The estimate names who files each permit and who schedules the inspections.

How are allowances handled?

An allowance is a set amount in a written estimate for finishes not yet chosen, such as tile, fixtures or cabinets. The contract states how the final selections are measured against it and how a difference above or below it is handled.

What happens if we change our mind on a finish mid job?

A change to a finish after the contract is signed is normally recorded in a change order. The contract states how a change order is priced and approved, and materials already ordered or installed can affect what a change involves.
